The use of the City of Santa Monica's Big Blue Bus Route Data ("Route Data") is subject to the following terms and conditions of use. By using the Route Data, you agree to accept and be bound by the following terms and conditions of use:
License. The Route Data is provided under the terms and conditions set forth in the Open Data Commons Attribution License (ODC-By) v1.0.
Permissible Use. The Route Data consisting of the general transit feed specification data of the Big Blue Bus is available as a resource to promote the purpose of public transportation and to make bus route information readily accessible to members of the public. You agree to use the Route Data in a manner consistent with these purposes, and in compliance with all applicable law.
"As Is." The Route Data is provided on an "as is" basis and may be modified, changed or updated at the City's sole discretion. The City makes no representation or warranty of any kind, express or implied, as to the operation or content of the information, and disclaims any warranty of merchantability or fitness for a particular purpose. The City will not be liable to you or any third party for any damages of any kind arising from the use of the Route Data or to any site to which it is linked, including, but not limited to, direct, indirect, punitive or consequential damages.
Intellectual Property. The City of Santa Monica owns all copyrights, trademarks and other proprietary rights in and to the name "City of Santa Monica," "Big Blue Bus," "BBB," Big BLUE Bus (collectively, the "Marks") as well as the graphic or other representation of such names, its logos, service marks, artwork, photographs, and other rights to and material relating to such Marks. In the event you request to use any of the Marks, such request shall be made in writing and in advance, and may be denied in the City's sole discretion.
Indemnification. You agree to defend, indemnify and hold harmless the City of Santa Monica, its officers, directors, boards and commissions, employees and agents, from and against any all claims, damages, obligations, losses, liabilities, cost and expenses (including reasonable attorneys' fees) arising from the (i) use of the Route Data, (ii) violation of any term of these terms and conditions of use, or (iii) any claim that your use caused damage to a third party. The obligation to defend, indemnify and hold harmless shall survive the termination of these terms and conditions of use.
Termination. The City reserves the right, at its sole discretion, to suspend or terminate the use and availability of the Route Data, with or without cause.
Applicable Law. The laws of the State of California shall govern all rights and obligations under this Agreement. By consenting to these terms and conditions of use, you agree that venue for any dispute arising from these terms and conditions of use shall be brought in either the United States District Court for the Central District of California or the Superior Court of California, Los Angeles County, West District, and to personal jurisdiction in either court.
